Terms and conditions

General
These are our general terms and conditions. Together with the references contained herein, these terms and conditions apply to any agreement that we enter into with you.

We reserve the right to amend these Terms from time to time. By entering into an agreement with us, you agree that the most recent version of our terms and conditions will always apply.

Products
Romeo Lugan has the right to adjust prices, involve additional cost and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the product. The pictures may differ depending on the color settings in your computer. All pictures should be seen as illustrations only, and do not guarantee correct appearance and characteristics.

Payments
The (total) price of our products are indicated in our webshop. The prices include VAT, but exclude any customs duties and additional taxes. You pay through our online payment service Mollie. Pay with your MasterCard, Visa or AMEX securely. Your payment is handled by Mollie with secure encryption and under strict banking standards. Romeo Lugan does not store any credit card numbers. Your card details are sent directly to the bank and cannot be read or accessed by anyone other than your bank. There is no extra charge for card payments. When paying by credit/debit card the conditions apply as soon as the card transaction is approved. In the event that no payment has been received after submitting your order, Romeo Lugan may automatically cancel your order.

Delivery
We will deliver your product to the address you have specified. Once we have dispatched your product, we can no longer amend the address. QLS is our fulfilment partner and handles distribution of our products. When your product is dispatched, we will give you a track & trace code, which gives you the opportunity to trace your product. We undertake to deliver products within five business days. If a delivery is delayed, we will notify you via e-mail. We guarantee that a delivery will always be made within 30 days of our order confirmation. If we do not meet that guarantee, you have the option to request an immediate refund of the purchase price for the product(s), or request that we send a product that replaces the initial product.

Returns
You can always return a product, provided you do so within 14 days of receipt (the “withdrawal Period”). To return products, you can fill out the return-form, or send an email to support@romeolugan.com. Upon confirmation by us, you must send the product back within 14 days. We will fully refund the purchase price within 14 days after having received your returned product.

We have a free return policy. This means that you will receive a free return label from us. It is important that you do not return on your own, but use our return label. In this way, you are assured of a smooth handling of your return.

During the Withdrawal Period, you shall exercise due care in handling the product and its packaging. You will only remove packaging and use the product to the extent that this is necessary to establish whether or not you want to keep the product.

Once you remove the clip on the crown of the watch and/or the foil on the dial and/or the plastic around the strap, the right to return will lapse. After all, at that moment you decide to put the watch into use and keep it. You can try out the watch perfectly without removing these protective materials.

In the event of loss of value due to use of the watch that exceeds the short-term testing, we reserve the right to issue only a partial refund.

Warranty
We provide a warranty period of two years on the movement and not to other parts such as the sapphire glass or the stainless steel strap. Wear traces visible on the watch, must be considered as normal effects of usage. If the watch becomes damaged through normal use, you are entitled to a replacement watch. You have to send us the defective product – if reasonably possible – in the original packaging. The shipping costs will be paid by Romeo Lugan. To claim under our warranties, the buyer needs to present the original purchase documentation received from Romeo Lugan. The warranties no longer apply in case a third party performed repair or other works on the watch without prior written permission by Romeo Lugan.

Personal Information
When shopping with Romeo Lugan we will save some of your data to fulfill your purchase. Romeo Lugan treats all personal information confidential. You have the right to request access to your data and if there is anything wrong you can get it changed or removed. Romeo Lugan may also use cookies, for example in order to improve your experience of the webshop.

Liability
We are not liable for any damages that may be caused as a result of you using the product. However, we are liable for damages that result from our willful misconduct or gross negligence. In any case, our liability will never exceed the purchase price of the product that caused the damage.

Intellectual property
All intellectual property (including: copyrights, wordmarks and trademarks) in relation to our text, photo’s, videos or any other materials, are owned by us (or are used by us with permission of the owners). You shall refrain from committing any acts that may infringe these rights.

Complaints
If you have a complaint, we would like to hear it. Please file your complaint as soon as possible by sending a detailed description to support@romeolugan.com. We will process your complaint as soon as possible, but in any event within two business days. Should it take longer to handle your complaint, you will receive a notification within two business days to confirm that we have received your complaint, together with an indication of when we expect to respond. If we cannot settle a complaint amongst us, your complaint will be dealt with in accordance with the dispute section below.

Disputes
Dutch law applies to these Terms. Subject to mandatory legal provisions providing otherwise, any conflicts that may ensue from these Terms, will be submitted to the jurisdiction of the Dutch Courts, in the district Gelderland. As a consumer you can also use the ODR-platform (Online Dispute Resolution). This platform offers a simple, efficient, fast and low-cost out-of-court solution to disputes arising from online transactions. For more information see: http://ec.europa.eu/odr
